For the most part, these letters are delivered certified mail and allow thirty days for either the individual or business to respond. Final Notice of Intent to Levy

Levies on businesses can be especially crippling, as cash flow to keep the business operational can be compromised, and accounts payable will be sent notices demanding payment of all outstanding invoices directly to the IRS.   • A statement whether the amended returns involve PFIC issues during the tax years covered by the 2011 OVDI period.
  • Ordering of copies of offshore financial account statements reflecting all account activity for each of the tax years covered by your voluntary disclosure. Provide an explanation of any differences between the amounts reported on the account statements and the tax returns.
  • Negotiations with the Revenue Agent once the case is accepted into the Voluntary Disclosure Initiative for the lowest penalty possible.
  • Negotiations with the IRS on the assessed offshore penalty. Preparation of the tax resolution, such as an Offer-in-Compromise, Installment Agreement, Partial Pay Installment Agreement, etc.

FBAR Background

The original FBAR created the Bank Secrecy Act, which gave the Department of Treasury authority to establish record keeping and filing requirements for U.S. persons with financial interests in or signature authority or other authority over financial accounts maintained with financial institutions in foreign countries.

This provision of the law requires that a Form TD F 90-22.1, Report of Foreign Bank and Financial Accounts (FBAR), be filed if the aggregate balances of such foreign accounts exceed $10,000 at any time during the year. This form is used as part of the IRS’ enforcement initiative against abusive offshore transactions and attempts by U.S. persons to avoid taxes by hiding money offshore. This includes any interest a US person has in:

  • Offshore bank accounts
  • Offshore mutual funds
  • Offshore hedge funds
  • Offshore variable universal life insurance policies
  • Offshore variable annuities a/k/a Swiss Annuities
  • Debit card and prepaid credit card offshore accounts

The provisions commonly known as the Foreign Account Tax Compliance Act (FATCA) became law in March 2010. Per the IRS guidelines:

Claim #1: The OIC can settle tax debt for ‘pennies on the dollar’.

True and False. While we find this statement to be grossly misleading, as it implies simplicity to settling outstanding tax debt, the Offer in Compromise can dramatically reduce a taxpayer’s tax liability. In most cases, savings can be in the thousands of dollars and the taxpayer can finally get a fresh start. To qualify for an Offer, however, is very specific, and if not done correctly can cause much more harm than good.Hiring a firm with years of experience and a skilled legal team is very important, as it can help stack the odds for a favorable Offer in Compromise in your favor should you qualify. Participants must also pay back-taxes and interest for up to eight years, plus accuracy and delinquency penalties.
  • A lower, 12.5% penalty for those whose previously secret accounts did not hold more than $75,000 for any year from 2003 to 2011. And an even lower 5% penalty limited to special circumstances, such as those who inherited offshore accounts and had little involvement with them.

  • Forms 3520, 3520-A, 5471, 5472, 926 and 8865 for all tax years covered by the voluntary disclosure.
  • Amended estate or gift tax returns (original estate or gift tax returns, if not previously filed) for tax years covered by the voluntary disclosure necessary to correct the under reporting of assets held in or transferred through undisclosed foreign accounts or foreign entities.
  • A statement whether the amended returns involve PFIC issues during the tax years covered by the 2011 OVDI period.
  • Ordering of copies of offshore financial account statements reflecting all account activity for each of the tax years covered by your voluntary disclosure. Provide an explanation of any differences between the amounts reported on the account statements and the tax returns.
  • Negotiations with the Revenue Agent once the case is accepted into the Voluntary Disclosure Initiative for the lowest penalty possible.
  • Negotiations with the IRS on the assessed offshore penalty. Preparation of the tax resolution, such as an Offer-in-Compromise, Installment Agreement, Partial Pay Installment Agreement, etc.

FBAR Background

The original FBAR created the Bank Secrecy Act, which gave the Department of Treasury authority to establish record keeping and filing requirements for U.S. persons with financial interests in or signature authority or other authority over financial accounts maintained with financial institutions in foreign countries.

This provision of the law requires that a Form TD F 90-22.1, Report of Foreign Bank and Financial Accounts (FBAR), be filed if the aggregate balances of such foreign accounts exceed $10,000 at any time during the year. This form is used as part of the IRS’ enforcement initiative against abusive offshore transactions and attempts by U.S. persons to avoid taxes by hiding money offshore. This includes any interest a US person has in:

  • Offshore bank accounts
  • Offshore mutual funds
  • Offshore hedge funds
  • Offshore variable universal life insurance policies
  • Offshore variable annuities a/k/a Swiss Annuities
  • Debit card and prepaid credit card offshore accounts
As this may be the last opportunity for taxpayers to resolve unreported foreign income issues without criminal prosecution, we recommend that taxpayers in this situation act immediately and seek assistance from an IRS debt tax attorney.

FATCA – Foreign Account Tax Compliance Act

The provisions commonly known as the Foreign Account Tax Compliance Act (FATCA) became law in March 2010. Per the IRS guidelines:

  • FATCA targets tax non-compliance by U.S. taxpayers with foreign accounts
  • U.S. individual taxpayers must report information about certain foreign financial accounts and offshore assets on Form 8938 and attach it to their income tax return, if the total asset value exceeds the appropriate reporting threshold. Form 8938 reporting is in addition to FBAR reporting.
  • To avoid being withheld upon, a foreign financial institution may register with the IRS, obtain a Global Intermediary Identification Number (GIIN) and report certain information on U.S. accounts to the IRS.

IRS Forms – Get To Know Them

Tax Information Authorization 8821

This form is the first step in representation, and allows us to order your master tax file from the IRS. This is very important as it gives us the opportunity to review your file for errors and to accurately determine the best tax relief solution to apply.

Power of Attorney 2848

The 2848 is a limited IRS power of attorney form, providing us authority to represent your interests directly with either the IRS or state collection authorities. This is not an estate power of attorney form, it is only used for tax purposes. Much like an attorney representing you in a courtroom, this allows your assigned attorney or tax relief professional to speak on your behalf with either revenue officers or IRS agents, and is a very powerful tool in the tax relief process.

  • Who qualifies for a tax relief program?

    If you have a tax debt, and the IRS or state collection agencies are in the process of collecting, both individuals and businesses can qualify for certain tax relief measures. These could be a reprieve against collections wherein all notices and threats of asset seizure are suspended, an agreement to waive accrued penalties on the initial tax liability, or in certain cases a suspension of collection altogether and a mediation of the tax liability. As qualifications for these measures vary from case to case, understanding your options and getting current with an accurate road-map are important considerations our associates will sit with you and go over in depth.
  • Do you have attorneys?

    Yes! Our hard working team includes attorneys, seasoned in all aspects of IRS collections and settlement proceedings. Some tax providers claim to use attorneys when they really don’t. You can verify this by requesting them to send you a 2848 form (which we just reviewed in the previous question). On this form, you will be able to see who is representing you. If the representative is not an attorney, you do not have an attorney representing you. It’s as simple as that. Besides attorneys, we also have Enrolled Agents on staff. It is our belief that different educational backgrounds bring a unique perspective to each case, and help to better service the many different areas of tax resolution for our clients. Note: Due to normal staffing variances, we may or may not have both forms of representation available at all times during the year.
  • Can I use my local CPA or tax attorney?

    Yes, but ask questions. Tax planning, mediation and collection work is a niche service, and is one the requires years of experience and knowledge. While your local CPA or Attorney may have a general understanding of your liability issue, the difference between our specialties is similar to hiring a general physician to perform open heart surgery; education and experience are dramatically different.

    Liability issues is all our firm does, and we have become an expert in the field, consulting both individual taxpayers and corporations across the nation for the past ten years. As our volume of cases is so high, we are able to offer our services at affordable rates relative to some attorneys or CPA’s who charge by the hour with limited knowledge of tax law.
  • Are you a law firm?

    StopIRSDebt.com is a tax resolution firm, not a law firm. Our sole area of focus is on mediating and resolving difficult tax liability matters before the IRS and State taxing authorities. We are a team of dedicated tax professionals with one singular goal in mind: to get you the best tax relief results possible. That means rolling up our sleeves and tackling wage garnishments, bank levies, un-filed tax returns, settlements and calming aggressive revenue officers.   • How does the process work?

    For most cases involving a tax liability, we begin representation by having you sign and remit to us several IRS forms. The first is an 8821, which allows us to order your master tax file and see how much is owed and for what years. The second form is a 2848 which, as discussed previously, allows us to speak directly to the IRS on your behalf so that we can request a hold against collection action and negotiate directly with your assigned revenue officer. We then send you a financial questionnaire which must be filled in and sent back to us. At that point, there will be some back and forth between you and our firm as we work to prepare your resolution matter and/or negotiate directly with an assigned revenue officer. Depending on the resolution matter, cases will vary moving forward, but these are the basic steps to getting represented.
  • How much does it cost?

    Some firms will charge clients very little up front for representation, or put them on a small payment plan wherein the client can pay a small amount every month towards their fee. Companies that allow you to pay the fee over time have recently been accused of delaying representation until they are paid in full, and bargain basement programs offer minimal assistance and could have many hidden costs that are not initially disclosed. We have been in business for over twelve years, and find that it benefits the consumer to pay a fair fee for a fair service. There are simply no cutting corners.
